REGULATIONS - PLUS web design studio

§1 SUBJECT MATTER

The Regulations below specify how hosting accounts and other services provided to the Subscribers in return for the fees they pay are installed and used on the servers belonging to PLUS. within the site www.webandseo.co.uk (hereinafter referred to as "PLUS - web design studio"). Payment of the subscription fee is tantamount to the approval of these Regulations. Complaints based on the ignorance of the Regulations will not be processed. PLUS - web design studio reserves the right to make any modifications to these Regulations and accordingly notify the Clients thereof twenty days before such modifications become effective via an administrative and information panel to which every Client gains access upon activation of its "PLUS - web design studio" account.

§2 PRIVACY

"PLUS - web design studio" ensures e-mail privacy of its Subscribers and does not intercept information transmitted through the "PLUS - web design studio" mail servers. In extreme cases, we reserve the right to make your e-mails available to duly authorised government bodies. "PLUS - web design studio" does not make your personal details available to any third party whatsoever, except for duly authorised government bodies.


§3 FEES

All services (excluding free demo accounts) are activated after an appropriate fee is paid as quoted in the pricelist available from the "PLUS - web design studio" site (we activate your account against a legible payment receipt e-mailed to billing@plus-uk.net), but we can suspend a service should the money not reach our account for any reason beyond PLUS - web design studio control.
If the Subscriber pays a subscription fee by money order, bank transfer, cash or other electronic payment method, the account will be activated by "PLUS - web design studio" within 24 hours (on weekdays, from Monday to Friday) once an appropriate amount is credited to "PLUS - web design studio" account or a legible payment receipt is e-mailed or faxed to us.

Before the expiration of a billing period a pro forma invoice will be sent to the Subscriber's e-mail address specified when placing the order to request payment to renew the services. Failure to make such payment will result in the agreement being terminated. The Subscriber will be notified by phone of any account suspension or the upcoming expiration date of the Subscriber's domains (provided that the Client's current and correct phone number is available to "PLUS - web design studio"). Monthly invoices for Dedicated Servers must be paid 14 days prior to the next billing period and otherwise "PLUS - web design studio" reserves the right to suspend the server. Your domains will be renewed for the next billing period only and exclusively after the payment is credited to PLUS - web design studio account or a legible payment receipt is faxed or e-mailed.
"PLUS - web design studio" disclaims any responsibility for problems due to payment delays caused by third parties such as banks, post offices etc.

§4 "PLUS" - LIABILITY

The "PLUS - web design" servers are available to the Subscribers round the clock. "PLUS - web design studio" reserves the right to switch them off temporarily due to periodic maintenance of the system or unexpected situations such as natural disasters. Should there be a need to switch off any of the services, then "PLUS - web design studio" undertakes to notify its Subscribers thereof in reasonable advance. Should the "PLUS - web design studio" servers be unavailable due to "PLUS - web design studio" reasons for more than 24 hours, then "PLUS - web design studio" undertakes to pay back double the rate that would be otherwise charged for the period during which the account is unavailable. "PLUS - web design studio" should not be held liable for any losses that "PLUS - web design studio" Clients might sustain due to:

  • disconnections caused otherwise than by the fault of "PLUS - web design studio",
  • disasters,
  • acts of any agents or third parties,
  • improper use of accounts,
  • non-receipt of electronic mail

"PLUS - web design studio" does not assume responsibility for any materials on the Subscriber's account. The account is activated once a payment receipt is submitted or the money reaches the account. "PLUS - web design studio" undertakes to make back-ups and store them on independent servers. Within two months and 14 days from the payment date the Client has the right to claim the return of money paid for any Domain Transfer which has failed. Thereafter we do not return the fee paid for any failed transfer.

§5 SUBSCRIBER LIABILITY

Regardless of their nationality, the Subscribers are obliged to comply with Polish laws and common rules for use of the Internet. Agreements for use of dedicated servers may be terminated upon a prior one-month's notice. Those who use dedicated servers are obliged to inform "PLUS - web design studio" about their resignation one month in advance. "PLUS - web design studio" reserves the right to suspend or remove an account without returning any amounts paid if: such an account stores any contents that are against Polish or international laws, are racist, fascist, violence-related or call for religious, racist or denominational hatred, the Subscriber acts to the detriment of other "PLUS - web design studio" or Internet users, the Subscriber uses any form of spam, the service fee has not been paid or any of these Regulations has been infringed.
The "PLUS - web design studio" reseller should be held liable for any materials appearing on the portion of the server made accessible to third parties. Any failures caused by malfunctioning servers which continue for more than six hours must be reported by phone. The details are available after logging in on www.plus-uk.net. It is the responsibility of the Subscriber to update contact data, which can be edited after logging in on www.plus-uk.net.

§6 LIMITATIONS

On its servers, "PLUS - web design studio" prohibits the storage of any contents that are against UK or international laws, are racist, fascist, violence-related, call for religious, racist or denominational hatred or are commonly known as morally reprehensible.

In extreme cases, in which the server becomes overloaded due to the Subscriber's programs, thus deteriorating the services provided to other Subscribers, "PLUS - web design studio" reserves the right to impose some limitations or completely suspend the Subscriber's account. The Subscriber will be notified of any limitations through the administrative and information panel, where such limitations will be described, including a rationale for the steps being taken.

If 80% of the monthly allowable transfer resources are exploited, the Cpanel system automatically sends a notification of such a situation (provided that the Subscriber has typed in his/her e-mail address in the Cpanel system). After the limit is exceeded, the website is suspended until you contact us. A good solution could be to buy some additional GBs according to the pricelist or upgrade to a higher plan.

The reseller is obliged to make payments for each billing period one month in advance. Should the Reseller fail to pay on time or submit a legible payment receipt, then the Reseller's account is suspended after 14 days from the payment date after three attempts to contact the Client by phone. If for any reasons beyond "PLUS - web design studio" control we are unable to contact the Client (a wrong e-mail address or phone number) and the fees are not paid on time, "PLUS - web design studio" reserves the right to suspend the hosting service within ten days from its expiration. If by the expiration date of a Polish domain "PLUS - web design studio" does not receive a renewal fee, such a domain becomes automatically suspended. A non-renewed foreign domain is automatically suspended by the company with which it has been registered after 30 days from its expiration date. "PLUS - web design studio" assumes no responsibility for any wrong client details in the panel, which the Client can update personally after logging in on www.plus-uk.net

§7 TERMINATION

Resignation from "PLUS - web design studio" services upon the Subscriber's request does not oblige "PLUS - web design studio" to return the fee for any extra free services bundled into a single package (i.e. website design, toy car etc.). The cost of extra bundled services (including free services) will be withheld from the money being returned.

Termination of the agreement upon "PLUS - web design studio" request obliges "PLUS - web design studio" to return the Subscriber an unused portion of the subscription fee for the service provided, excluding fees for any additional services, unless the Subscriber is in breach of any of these Regulations. In such an event an application for money back will be left unprocessed.

The agreement between the Subscriber and "PLUS - web design studio" becomes terminated if a payment receipt is not submitted within five days from the expiration date of the previous service. Resignation from "PLUS - web design studio" services and return of costs incurred by the Client may occur after 30 days from account activation, i.e. from the payment of money to "PLUS - web design studio" account.

§8 INVOICING

In the month in which the service is activated "PLUS - web design studio" makes out a relevant invoice, which is sent to the address designated by the Client. Invoices are served by traditional post only upon the Client's explicit request. An option to receive invoices by traditional post should be checked when activating an account.
